DRYDOCKING EXPENSES DUE  TO PARTICULAR AVERAGE

When the vessel has a claim and it needs to be repaired for particular average , there is 2 ways  for the owner but sometimes it needs to be carried out temporary repairs for the safetly of the vessel or immediately to be repaired.

Together with this; it is always wondered how the costs of the repairs will be calculated between the underwriters and the owners. Lets check the situations.

The cost of docking  and undocking  the vessel together with the dock dues for the relevant period from a claim against in full except where such repairs are effected concurrently with owner’s repairs which also require the use of the drydock and which are either ;immediately necessary for the seaworthiness of the vessel or effected on the occasion of a routine drydockking.

In each of the above cases the costs of docking and undocking the vessel are halved , together with the dock dues for the common period.

On the other side; the owner can take advantage of the situation to out his own repairs in drydock even though the repairs are required for the classification purposes and the drydock expenses will fall to be borne by underwriters.

If we give an example  at a routine drydock repairs  are carried out in drydock ;

Particular average : 10 days

Owners : 15 days

 Under the curcumstance showed above the owners will bear half of the drydock expenses even where more than one set of particular average repairs are effected;

The similar principle of division is generally applied also to expenses such as the following ;

·         *  Tank- cleaning / gas- freeing
            *  Superintendent’s charges
·         * Watchman, fire line and the other general expenses charged on a Daily basis.    

 So,   I hope the above can be easily understood how the calculations are made , not to cause any problem with the parties.

  1. Hocam teminat altındaki tekne&makine hasarlarının tamiri için geçen süre içerisinde gemi çalışmadığından armatörün zararını karşılama noktasında verilen teminat var mı? Örneğin gemi ana makinesi kullanılamaz hale geldi ve değişimi yapılacak .ana makine temini ve montajı toplamda 3 aylık bir süre alacak.haliyle gemi 3 ay çalışamayacak.running cost 2000 USD 3 ayda 180.000 USD.sigortanin bu anlamda verilen teminatı varmı?
